1. Property is marketed in accordance with Landlords Individual Requirements

2. References :-
Students – Student Union Card and proof of Admission to a course is deemed sufficient.
Others – References may be taken from Employers, Previous Landlords or other suitable persons.

3. Rent – Once rent falls due and it has been received this is paid to the Landlord within 7 working days of the month following the month for which the rent is due. Rent is paid less the Agents Commission and disbursements and other amounts payable.

4. Commission Rates:
Full Management- 10% of all rent received plus VAT. (Management encompasses collection of rents, advertising, and to arrange to carry out any works of normal maintenance).
Let and Collect Rent Only-8% of all rent received plus VAT
Let Only-5% of all rent received plus VAT

5. If a refundable Deposit is required as Security by the Landlord for non compliance by the Tenant on any Terms/Conditions in the Tenancy Agreement then this will be held by 1-2-1 Property Lets as stakeholders.

6. The Landlord is responsible for ensuring his property is fully insured at all times.

7. The Landlord is responsible for fulfilling his Inland Revenue Tax Obligations and Income Tax Liability and will indemnify the Agent from any such liability.

8. The Landlord declares solemnly that the property provided for letting and management is either fully owned by them or they have obtained permission from other owners, mortgagees or other interested parties to let the property through us.

9. The Landlord agrees to appoint 1-2-1 Property Lets as the sole letting/managing agent for the property upto the expiry of the first tenancy negotiated by us, to be continued thereafter by mutual consent.

10. If, Solicitors have to be employed to deal with any matter of management of the Property, this will be discussed with the Landlord. The solicitor’s fees shall be paid by the Landlord. The Landlord will be liable for the payment of all court fees, professional fees disbursements or other expenses relating to the recovery of possession, arrears of rent or other monies and the enforcement action against any breaches of Tenancy Agreements relating to the let Property or for the defence of any claim relating to the let Property..

11. All furniture and soft furnishings provided by the Landlord must meet the Fire and Furnishing Regulations 1988

12. The Landlord must provide a valid Gas Safety Certificate, Energy Performance Certificate, Annual Fire Alarm Test Certificate and Electric Certificate and any other certificate as required by law. If the property is a HMO then this licence must be provided. If these are not provided then, if able, arrangement will be made to implement these and the landlord will be charged for the cost and service provided.

13. The Landlord must advise us if there are any restrictions in their freehold documents or lease e.g. roadside parking permits.

14. The Landlord must inform us if at any time the Landlords usual place of abode is outside the United Kingdom.

15. Repayment of Rent
a) The Landlord will be responsible for the repayment to the Local Authority of any rent where rent is received by the Agent and paid over to the Landlord and which afterwards is discovered to have been paid to the Agent in error or as the result of an overpayment of Housing Benefit or any other Benefit/Allowance or in any illegal manner.
b) The Landlord must repay any overpayment of rent or any rent paid to them in error back to the Agent on request.

16. The Agent does not guarantee the payment of rent nor that the tenant(s) will comply with any other contractual obligation of the tenant(s) and the Landlord cannot claim arrears of rent nor for any damage caused by the Tenants, their guests or visitors during the Term of the Tenancy from the Agent.

17. The Agent is not responsible or liable for any damage, injury or expense as a result of our letting or attempting to let the Landlords Property.

18. The Agent where possible will endeavour to obtain the Landlords approval for carrying out all necessary repairs or renewals to the Property/Furniture/Fixtures and Fittings/Furnishings or Equipment. The landlord agrees that should there be an emergency then the agent will be allowed to have emergency or urgent works carried out without the Landlords permission upto a maximum value of £200 plus VAT. An administration charge of 10% of the value of the works will be made to cover the Agents reasonable costs.

19. The Landlord is responsible for paying Council Tax or any other Taxes or expenses relating to the letting Property where such taxes/expenses are due because the Property is unlet.

20. The Agent will charge £40 per Tenancy Agreement for the registration of the Tenants Security Deposit with a Government Approved Scheme.

21. In a case where there are any disputes to be registered the Agent will charge £50 per property for the de-registration of the Tenants Security Deposit.
